Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern access to and use of the Estigator Workshop software (the "Service"), operated by Estigator ("we", "us", "our"). By registering a shop, creating a technician sub-account, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, incorporated here by reference. If you do not agree, do not use the Service.

2. What the Service does

Estigator lets a repair shop generate itemized, editable vehicle repair-cost estimates from damage photos, VIN/vehicle data, and/or diagnostic (OBD) fault codes, and to produce a claim-ready PDF report. Estimates are produced primarily by automated, AI-based image analysis and a pricing engine, priced against labor rate data and live parts sourcing.

An estimate is not a certified vehicle appraisal and does not replace a physical, in-person inspection. A shop's own technician remains responsible for reviewing, correcting, and signing off on any estimate before it is relied upon or sent to a customer or insurer.

3. Accounts, tenancy, and technicians

Registering a shop creates a "Workshop" tenant account. The registering owner is responsible for any technician sub-accounts created under that shop, for keeping login credentials confidential, and for all activity under the shop's account, including a technician's. You must provide accurate business contact information, and confirm your email address before generating estimates.

You may sign in using a password or via "Sign in with Google" — creating an account through Google Sign-In is also subject to Google's own Terms of Service, separate from these.

4. Content you submit

You are solely responsible for the photos, vehicle information, VIN, fault codes, claim details, and any other material your shop submits ("Your Content"), including that it belongs to a vehicle/customer your shop has a lawful basis to process. You grant us a limited, non-exclusive license to use, process, and store Your Content solely to provide the Service (generating estimates, producing PDF reports, and, in aggregate/de-identified form, improving our models and pricing accuracy).

5. Payments and billing

Paid features (per-estimate charges, subscriptions, or add-ons) are processed through our payment processors, Stripe and/or PayPal, and are described and priced before you're charged. A subscription renews automatically for its stated period unless cancelled.

6. Acceptable use

You agree not to: use the Service for any unlawful purpose or to submit fraudulent claims; attempt to circumvent rate limits, payment requirements, or access controls; reverse-engineer, scrape, or resell the Service; upload malicious files; or access or attempt to access another shop's data.

7. Disclaimers

THE SERVICE AND ALL ESTIMATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not guarantee that any insurer, lender, or third party will accept an estimate generated by the Service, or that actual repair costs will match an estimate.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTIGATOR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO USE OF THE SERVICE OR RELIANCE ON ANY ESTIMATE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

9. Termination

We may suspend or terminate a shop's access to the Service if we reasonably believe these Terms have been violated. You may stop using the Service, or request account deletion, at any time — see our Privacy Policy for how to make that request.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
